I’m sure Sutton and his staff are stuffed into a conference room, drinking bad coffee and conducting major damage control operations.

© 2007 WorldNetDaily.com A Department of Homeland Security memo obtained by WND indicates fingerprints were found on the vehicle abandoned by a Mexican drug smuggler who was given immunity to testify against border agents Ignacio Ramos and Jose Compean, apparently contradicting the U.S. attorney’s claim that he had no evidence to prosecute the smuggler. U.S. Attorney Johnny Sutton repeatedly has said there was no evidence at the scene on the Texas border near El Paso that would have permitted his office to investigate, find and prosecute Osbaldo Aldrete-Davila, whose testimony against the officers led to prison terms of more than 10 years. The DHS memo also documents that no fingerprint search was conducted on the vehicle until a full month after the Feb. 17, 2005, incident. Despite repeated attempts, Sutton’s office did not return WND phone calls to comment on this story.
Andy Ramirez, who has closely followed the case as chairman of Friends of the Border Patrol, said he was disturbed that evidence in the van was handled by a combination of local, sheriff and federal law enforcement officers.
“From the scene, the vehicle is towed to the El Paso sheriff’s office,” Ramirez noted. “Then, the Border Patrol turns over the fingerprints to the El Paso Police Department for processing. DHS is involved, but only to receive a copy of the videotape made of the fingerprint processing. These law enforcement procedures are highly irregular, especially in the emotionally charged areas of border security and drug enforcement.”
From the beginning, Ramirez, insisted, “Johnny Sutton’s only interest in this case was to prosecute Ramos and Compean.”
“If Sutton wanted to capture the drug dealer, the van would have been secured, the van and its contents would have been dusted immediately for fingerprints and the chain of evidence would have been established,” he said. “Instead, the van sat there in the El Paso sheriff’s office for nearly a month before any law enforcement looks for evidence of the drug crime.”
Ramirez wondered why the FBI or the Drug Enforcement Administration was not called in immediately on the case.
“Instead, when the prosecutors finally get around to looking for fingerprint evidence, who knows how corrupted the fingerprint evidence is going to be after a month?”
A frustrated Ramirez contended Sutton was not interested in evidence from the van, because he was never out to get the drug smuggler.
“Since the fingerprint evidence would not implicate the agents, Sutton couldn’t have cared less if there was any fingerprint evidence or not,” Ramirez said. “If the fingerprint evidence could have implicated Ramos and Compean, Sutton would have been after the fingerprints with a vengeance.”
The DHS memorandum of activity was filed by Special Agent Jose L. Arredbado, March 20, 2005. The memo documents that March 17, 2005, special agent Arredbado received a copy of the vehicle towing receipt from the El Paso sheriff’s office where the vehicle had been towed from the Fabens, Texas, Border Patrol Station.
The memo indicates that March 17, 2005, Arredbado authorized the U.S. Border Patrol Evidence Team to enter the compound and dust the vehicle for fingerprints. The team found 11 fingerprints, three of which were duplicates. The prints were taken to the El Paso Police Department for processing, with an agreement to turn the findings and report over to the DHS Office of Inspector General upon completion.
A towing receipt obtained by WND shows the vehicle Aldrete-Davila drove was a silver 1989 Ford Econoline with Texas plates that was taken to the Fabens, Texas, Border Patrol Station, Feb. 18, 2005, the day after the incident with Aldrete-Davila that has led to the imprisonment of Ramos and Compean.
The towing receipt indicates the Ford Econoline remained at the Alba Wrecker Service in El Paso for 18 days, until March 7, 2005. The DHS report indicates Alba transported the vehicle to the El Paso sheriff’s vehicle compound March 10, 2005, a discrepancy with the March 7, 2005, date noted on the Alba towing receipt.
The towing receipt indicates the bill went to the Drug Enforcement Administration. Crossed out is an initial designation that indicates the bill was originally intended to go to the Border Patrol.
John Godinez, assistant to Mary Stillinger, the defense counsel for Ignacio Ramos, told WND his office was aware there were some fingerprints found on the van, but the defense had not pursued the issue. Mr. Godinez affirmed that during the Ramos-Compean trial, the prosecution did not introduce into evidence the fingerprints or any of the documentary evidence regarding the fingerprints. Proving that the van was driven by Aldrete-Davila was never in contention in the trial after the prosecution gave the drug smuggler immunity to testify.
In his Jan. 19 exclusive interview with WND, prosecutor Sutton strongly maintained there was nothing at the crime scene that would have permitted him to identify and pursue the fleeing Mexican drug smuggler.
WND: So, Aldrete-Davila ran away, and as you say, at the time you didn’t have any basis to know who he was and there were no fingerprints. But yet, you found the guy. If you found the guy to give him immunity, why couldn’t you have found the guy to punish him? Sutton: The way we found him is that he came forward and was in Mexico with a lawyer. So, the only way to get him to testify was to give him immunity from being prosecuted. He wasn’t going to agree to come to the United States, he wasn’t going to agree to talk, unless he had some kind of immunity from being prosecuted for that load. So, that puts the prosecutor in the terrible choice of everyone goes free, we got no case against the dope dealer, we cannot make a case against the dope dealer because there’s no evidence thanks to agents and other factors.
As we WND previously reported, Sutton stated a Mexican lawyer brought Aldrete-Davila forward, without revealing the drug smuggler’s identity, until immunity had been granted. However, WND can find no documentation any such Mexican lawyer was involved.
DHS investigative memos make clear that Border Patrol agent Rene Sanchez in Wilcox, Ariz., identified Aldrete-Davila only days after the Feb. 17, 2005 incident, obtaining his information through family connections. Sanchez grew up with Aldrete-Davila in Mexico.
The information about Aldrete-Davila’s identity was then passed on by Sanchez to DHS special agent Christopher Sanchez, who went to Mexico and found Aldrete-Davila.
This Christopher Sanchez is the same DHS special agent the DHS memo on the fingerprints says received the videotape of the El Paso Police Department fingerprint search on the drug smuggler’s abandoned vehicle.

I have always known that something was bad wrong with the

in favor of residents of another country. One can only speculate as to what motivated Mr. Sutton. I think it’s very clear that the wrong individual(s) went to prison. When can we expect something to be done in this case?
This is indeed a sham of a case against two Border Patrol Agents doing their job. Something is very suspicious in this case and it appears like the government went after the two agents for trying to stop drug dealers. One wonders if Attorney Sutton and or Agent Christopher Sanchez are involved with these drug dealers. Also some of the Border Patrol Agents who testified at the trial have been dismissed for lying at the trial. So we have lies all the way around on the government case and the only truth is that two Border Patrol Agents were railroaded for doing their job! It looks like the republican administration of George Bush is in bed with drug dealers now. What a farce of justice.

It continues to baffle me as to why our border patrol agents show up to work each day. Why is that the Mexican goverment has any role in how we handle our affairs, they have no clue as to how to handle their own. They are a corrupt government and let drug dealers run their country. Apparently their drug dealers are now running ours. I have never been one to pull the race card however I find it curious that both Agents convicted are hispanic. Perhaps a bit more expendable than a white agent.
I live here in El Paso, where the illegals are taking all our benefits mean’t for American’s. I don’t understand why we have to support Mexico. I read everyday about crimes committed by citizens from that country, yet they never seem to get prosecuted for it. If we are caught over there for anything, wer’e sent to prison. A review of all the cases Johnny Sutton has prosecuted leads one to an obvious conclusion….The Western District symbol of Lady Justice is now draped in red, white and green. Review one of Sutton’s early cases. Agent Gary Brugman….weapon never drawn, no shots fired, no injuries and no medical attention required for the illegal. Sutton in true fashion, used a convicted drug smuggler to testify against Agent Brugman. What really makes this obscene is agent Brugman had arrested the Drug smuggler that was testifying against him. It doesn’t take a legal scholar to understand how corrupt that is. Who in there right mind would expect unbiased testimony. I think most criminals would jump at the chance to testify against the Police Officer that put them behind bars! Great job dirty Johnny.

I have just seen two men get sentenced to 11-12 years for LYING. Those men shot that drug smuggler in the BUTTOCKS not the heart. seems they were shooting a warning shot. So after they shot the dude they find he did not had a weapon but was using some other means of displaying a gun. What would you do????

Two men doing their job and supporting their families,defending their borders and this is how our government treats them.I don’t understand what it is our politicians don’t get. Another former U.S. Border Patrol agent is due to start a prison term on Monday this man sentenced for a typographical error that he reported to authorities himself so that the situation could be corrected, according to a new report from Friends of the Border Patrol.
And the case bears similarities to the recent case involving two other Border Patrol agents Jose Compean and Ignacio Ramos sentenced to prison for shooting at a drug smuggler as he fled back into Mexico, leaving behind hundreds of pounds of drugs he’d brought into the U.S., said Andy Ramirez, chairman of the FOBP.
For example, the prosecutor who handled both cases against Ramos and Compean and Noe Aleman was U.S. Attorney Johnny Sutton, and the judge was Kathleen Cardone.
Sutton has been criticized for a number of his decisions in the Ramos-Compean case, including his choice to provide immunity to the drug smuggler and return him to the United States to help prosecute the law enforcement officers. And the judge, Kathleen Cardone, has been criticized for not allowing the jury to know that the incident involving the border agents was not the only drug-related incident involving the smuggler-turned-witness.
Sutton could not be reached by WND for a comment on the FOBP report.
The organization said the earlier “miscarriage” of justice happened in 2004, when Aleman, a senior patrol agent, notified authorities of a typographical error on an I-94 immigration visa form while he was in the process of adopting as his daughters his wife’s nieces.
The organization said Noe and Isabel Aleman were granted unconditional adoption of Saida, Yessica and Azucena, Mrs. Aleman’s nieces, in the El Paso courtroom of Judge Patricia Macias on April 12, 2004, and the couple picked up the children at the El Paso Port of Entry with Juarez, took them home and enrolled them in school.
When following up on some later paperwork, Aleman was surprised to see the children had been allowed into the United States on a document allowing only one business day, instead of the standard 90-day allowance.
“Agent Aleman then immediately reported what he and his wife thought was a typo error at the Hawkins (TX) Citizenship and Immigration Services office.
He was advised by an immigration attorney to ask for an adjudication officer and seek an extension of the ‘parole’ as it is known. Noe did exactly as he was advised, which he was informed by the immigration attorney, who guaranteed him that it would not be a problem having already gone through the adoption process with the Texas State District Court in El Paso,” the activist group said.
But when the Alemans later were told their visa had been approved, Aleman was arrested when he arrived to pick it up and charged with harboring illegal aliens, and their three daughters were taken into custody by the government, later to be deported, FOPB said.
“Here is just a sampling,” said Ramirez, “of what Sutton s prosecutors did to the Aleman family and how their civil rights were violated:
• “First, Noe was charged with smuggling his own legally adopted nieces. Yet, the government has never opposed the adoption paperwork as finalized by the State of Texas, which remains valid today. This was the same type of false statement that Sutton did to Agents Compean and Ramos though they claim that Agents Compean and Ramos are the wrongdoers and filed false statements.
• “Next, the government through agents from the Office of Inspector General and the FBI interrogated the Aleman daughters without counsel present and were trying to get the girls to admit they were being abused, which they vehemently denied. Is this not a violation of the civil rights of their daughters for being questioned without counsel present to protect their rights? When I think of what the government did to protect the non-existent rights of career drug smuggler Osbaldo Aldrete-Davila as compared to the civil rights of the Aleman girls, it makes any logical person sick knowing what happened to the Alemans, their daughters, and fellow Agents Compean and Ramos as well as their families.
• “After no evidence of abuse was discovered from this hostile and illegal interrogation, in which the girls were traumatized psychologically; Noe and Isabel’s daughters were, in retaliation for not lying to the government, placed in Removal Proceedings late June 2004.
• “At the Immigration Hearing on June 20, 2005, the girls, through their counsel, applied for Admission to the U.S. based on the fact that they are legally adopted daughters of U.S. Citizen Parents. The Immigration Judge denied the Application and ordered them removed. The Alemans appealed the decision to the Board of Immigration Appeals (‘BIA’), who upheld the original ruling. The Aleman daughters were subsequently deported though their legal and only family remains here in the U.S. The girls were deported and ordered ineligible to return to the U.S. for 10 years.
• “The Aleman girls were denied all visitation, and communication to their parents by the Department of Justice throughout this process, though, again, the girls are their legally adopted daughters.”

“What’s peculiar,” Ramirez said, “is that in conducting an independent investigation as I previously did in the Compean & Ramos case, I learned that a one-day pass is odd as 90 days is considered the standard for issued visas. To prosecute Agent Aleman is yet another example of the abuse of power of Johnny Sutton’s office and for him to go to prison in unconscionable when you consider that George W. Bush, former BP Chief and local El Paso Congressman Silver Reyes, and a large number of U.S. Senators support amnesty for what’s estimated to be 20 million illegal aliens.”
Ramirez also said Sutton’s assistants called the Aleman girls “little whores” during testimony before the grand jury.
“What has America become to engage in such tactics against its own citizens and children?” Ramirez questioned. “Noe and Isabel should have been given medals for going through a process and bringing home and a family to their nieces who live in the dangerous Juarez, MX region.”
“To think that many in Congress, and George W. Bush support amnesty for at minimum 20 million illegal aliens, while the Aleman’s were prosecuted for nothing more than a typo is unconscionable, despicable, and contradictory,” Ramirez said.
“What kind of disgusting place has America become to engage in such tactics against its own citizens and children. While this case has nothing to do with my job performance, it defines the hypocrisy of the so-called Department of JUSTICE who protects dopers, and not agents who do their job, families, or its children,” Aleman said in a website statement.
Aleman appealed his case, but recently lost his appeal and has been ordered to report for his one-year prison term on Monday in El Paso, Ramirez said.

Ramos and Compean have been in prison since January, when they were ordered to report for their terms of 11 and 12 years.
Ramos and Compean were convicted of shooting and injuring a drug smuggler, Osbaldo Aldrete-Davila-Aldrete, as he fled back to Mexico after driving across the border with a load of 742 pounds of marijuana in February 2005.
While under the protection of the grant of immunity from Sutton, Aldrete-Davila participated in another drug delivery, but the trial transcript in the Ramos-Compean case shows prosecutors successfully sought to have Judge Kathleen Cardone seal all information about Aldrete-Davila’s second drug bust from the jury.
Defense lawyers had argued the information about that incident as documented in Department of Homeland Security and Drug Enforcement Administration investigative reports went to the heart of the smuggler’s credibility when he told jurors his February 2005 escapade was the only time he’d done something like that.
“Mr Aleman didn’t discover the error and keep the info to himself, instead he immediately reported it to the Hawkins CIS office in order to secure the appropriate documentation as the honorable man he is,” Ramirez said. “Yet, Johnny ‘Satan’ Sutton’s minions chose to prosecute him, and violated not only his civil rights, but his daughters’ civil rights, too, the same rights they claim Osbaldo Aldrete-Davila had though he is a known and identified drug smuggler. We call on Congress to investigate the office of U.S. Attorney Johnny Sutton because it’s clear their conduct in each case has been a disgrace, especially taking into consideration the protection of criminals at the expense of the American taxpayers while prosecuting our law enforcement officers responsible for preventing smuggling and keeping narcotics off our streets.”

Of the eight DA s who were fired by Alberto Gonzalez for no good reason, the one imbecile should have gotten FIRED long time ago, the West Texas District DA, managed to keep his job by doing Bush’s dirty work, and eventually perpetrated this shameful act against the American people.
Bush said it’s a “complicated” legal process to pardon the 2 agents when he was cornered with the question, I guess that’s why he merely COMMUTED Scooter Libby’s sentence from 30 months to NO TIME in jail, with the stroke of a pen, citing it’s just too severe.
But, to be fair to Scooter, he perjured himself in front of the Congress for his two masters. What did the 2 agents do? Certainly nothing as important as hiding Little Dick and George’s willful and criminal act of leaking the name of a CIA agent.

I also think Johnny Sutton should have been one of the US Attorneys to be fired by Justice Gonzalez. The 2 border patrol agents sitting in jail have been served up one of this country’s worst cases of injustice. How ironic is it that the very people they are specifically hired to protect the citzens of the US against are the same people who actually put the agents behind bars. To say nothing of all the drug trafficking in which this illegal alien, Osbaldo Aldrete-Davila, has been involved. As far as bringing in Scooter Libby into the dicussion: first we all need to remember the fact that Libby was NOT the leaker of Ms Plame… On September 7, 2006, Richard Armitage admitted to being the source in the CIA leak to reporter Novak. Of course Scooter did not directly leak Plame’s ID, there’s no need to reiterate that fact, I watch the news too. He was convicted for obstruction of justice, making false statements and for lying about having knowledge of Little Dick and Big Bush’s “extra curricular” secret project in leaking Plames’s ID.
So to “A Concerned Life Long US Citizen” there is no need to defend this corrupt and inept administration and continue to be a die-hard Republican Jones’ Town Koolaid drinker. I prayed for Bush during his re-election and now I regret it EVERY DAY.
Today, July 19th, Bush in a town hall meeting ONCE AGAIN
refused to say whether he would commute the sentence. Citing the two men were convicted by the jury and the jury must have had ALL THE FACTS which we don’t have, and he said Johnny Sutton is his “good friend” back in TX and Sutton is fair and a straighter shooter. Yup, the good-ole-boys club again. Where do you think a two-bit ambulance chaser like Johnny Sutton got his backing from when prosecuting these two agents?
Let me remind you, Libby was ALSO convicted by a jury with much better evidence than Johhny boy had, yet the Great Decider was very quick in commuting the sentense. He just can’t endure to see poor Scooby Doo spend 1 day in jail, because… it just seemed harsh…awwwww…that was sweet.
But, did the Great Decider have all the facts that the jury had when convicting Scooby Doo? Oh wait, of course he does!!! Because Little Dick and Big Bush were themselves the ones who ordered Plame’s ID to be leaked in the first place, so of course he has all the facts!
So…to a Concerned Long Time US Citizen. Scooby Doo’s case ABSOLUTELY needs to be brought up and Bush needs to be cornered with it and be completely and utterly embarrassed and shamed into pardoning them, nothing less.

Where are these so called ” reverends ” Sharpton and Jackson these days ? Oh.. I forgot for a minute…. Ramos and Compean were protecting the borders of this country….and Sharpton and Jackson couldn’t care less about this country. And neither does Johnny Sutton.. obviously. First Nifong in North Carolina, now Sutton in Texas , what a bunch of incompetent fools…..definitely ruining this beautiful country.
I would be willing to bet My last dollar that Jorge Bush was giving Johnny Sutton his orders to railroad the two Border Agents. I don’t know why Bush is doing it but he definitely doesn’t have the best interests of the American people in his grand scheme.
I was recenlty on a deer hunting trip in Southern Arizona just a few miles from the border and I was shocked by the number of illegals I saw hiking around on the game trails. Every day I would sit up on the side of the mountain looking out over the valley with my binoculars and ever day I saw quite a few groups of illegals walking the trails with their jugs of water and makeshift backpacks.
My thoughts are that if it’s this easy to find illegal immigrants and I wasn’t even looking for them, and since the trails they are using are very obvious to see and are very well worn in trails that you can spot from miles away then why isn’t our govement able to stop them?
I believe it’s because immigration is a joke, the gov does not really seem to care and are only throwing enough people at the problem to make it seem like they give a shit, but it’s obvious that they don’t.
The real criminals in this case are the two assistant U. S. Attorneys, Debra Kanof and Jose Luis Gonzalez who prosecuted agents Ramos and Compean. My son in law, agent Ramos is in prison because of all the fabricated lies that were told to the jury by these two unethical attorneys. They not only gave immunity to the drug dealer but also to three agents who turned governement witneses and lied under oath to save their own skin. Those three agents admitted on the stand that Kanof threatened them with indictments if they did not change their original statements. They changed their statements three times. Sutton, Kanfof and Gonzalez should be disbarred and charged with aiding and abetting. Justice will prevail. I promise………………….
